1. Acceptance of these terms
By accessing or using hikariblue.com (the "Site"), you agree to be bound by these Terms of Use. If you do not agree, do not access or use the Site.
These Terms govern your use of the Site only. Commercial engagements with Hikari Blue are separately governed by a signed engagement letter or master services agreement, which supersedes these Terms for the scope of that engagement.
2. Definitions
- "Hikari Blue", "we", "our", "us": UNITED4 LLC, a Texas limited liability company operating under the Hikari Blue brand, with registered office at 14205 N Mopac Expy, Suite 570, Austin, TX 78728, United States of America.
- "Site": hikariblue.com and all sub-domains operated by Hikari Blue.
- "User", "you", "your": any individual or entity accessing the Site.
- "Content": all text, images, code, design, brand marks, methods, names, and materials published on the Site.
- "Engagement": a commercial relationship between Hikari Blue and a client, governed by a separately signed agreement.
3. Eligibility
The Site is intended for business users acting in a professional capacity. By using the Site, you represent that you are at least eighteen (18) years old or the age of majority in your jurisdiction, whichever is higher.
The Site is not directed to children under thirteen (13). We do not knowingly collect personal information from children under thirteen, consistent with the Children's Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501–6506).
4. Purpose of the Site
The Site presents Hikari Blue's services, team, methodology, and operating posture. The Site does not constitute an offer to contract, a binding commitment, a guarantee of outcome, or an invitation to make investment decisions. Forward-looking statements (planned certifications, target dates, capability roadmap) reflect current intentions and are subject to change without notice.
Commercial relationships are formed only by execution of a written engagement letter, signed by both parties. Until such an agreement is signed, no obligation, expectation, or representation made on the Site creates legal duties between the User and Hikari Blue.
5. Intellectual property
All Content on the Site is the property of UNITED4 LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
"Hikari Blue", "Hikari Blue Ops", and the Hikari Blue visual identity are trademarks of UNITED4 LLC. All other product names, company names, and service marks displayed on the Site are the property of their respective owners.
You are granted a limited, revocable, non-exclusive, non-transferable license to view the Content for personal, non-commercial evaluation of Hikari Blue's services. You may not reproduce, modify, distribute, publicly display, sell, lease, sublicense, or create derivative works from the Content without prior written authorization from Hikari Blue. Operator portraits are used with the express consent of each individual portrayed.
6. Accuracy of content
We make reasonable commercial efforts to keep the Site accurate and current. The Content is provided for informational purposes and may contain typographical errors, inaccuracies, or omissions. Hikari Blue reserves the right to correct any such errors and to update the Content at any time without prior notice.
Specific compliance and certification statuses are described in the Trust Center. The Trust Center supersedes any statement made elsewhere on the Site in case of conflict regarding compliance posture.
7. Third-party links and tools
The Site may reference or link to third-party services (including Anthropic, OpenAI, Mistral AI, Google Cloud, Netlify, Cloudflare). Such references are factual and do not imply endorsement by those parties of Hikari Blue, nor endorsement by Hikari Blue of any specific third-party service for your particular use case.
Hikari Blue has no control over the content, privacy policies, or practices of third-party sites and assumes no responsibility for them. Your interactions with third-party services are governed by those services' own terms and privacy policies.
8. Prohibited uses
You agree not to use the Site to: (a) violate any applicable law, regulation, or third-party right; (b) reverse engineer, decompile, or attempt to extract source code from any Hikari Blue platform or system referenced on the Site; (c) deploy automated scraping, harvesting, or data-mining tools against the Site beyond what is permitted by our robots.txt; (d) introduce malware, viruses, worms, or any malicious code; (e) attempt to gain unauthorized access to the Site, our infrastructure, or related systems; (f) impersonate any person or entity or misrepresent your affiliation with Hikari Blue.
9. Disclaimer of warranties
THE SITE AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. HIKARI BLUE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of certain warranties; the above exclusions apply to the maximum extent permitted by applicable law.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIKARI BLUE, UNITED4 LLC, OR ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE.
IN ANY CASE, HIKARI BLUE'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$ 100.00).
This limitation does not apply to liability that cannot be limited or excluded under applicable mandatory law.
11. Indemnification
You agree to defend, indemnify, and hold harmless UNITED4 LLC, its members, officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or third-party right; (c) your breach of any representation or warranty made under these Terms.
12. Modifications to these terms
Hikari Blue may revise these Terms at any time by posting an updated version on this page. Material changes will be flagged at the top of this page on the effective date. Your continued use of the Site after the effective date constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, including without limitation the Texas Business and Commerce Code, without regard to its conflict-of-laws principles.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
14. Dispute resolution & arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Site shall first be addressed through good-faith negotiation between the parties for a period of thirty (30) days from written notice of the dispute.
If the dispute is not resolved through negotiation, it shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, by a single arbitrator, in Austin, Texas, in the English language. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in the state or federal courts located in Travis County, Texas, to protect its intellectual property rights or confidential information.
Class actions, class arbitrations, and consolidated proceedings are not permitted. Each party waives any right to participate in such proceedings.
15. Severability
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction or arbitrator, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
16. Entire agreement
These Terms, together with the Privacy Policy, the Cookies & Local Storage statement, and any signed engagement letter, constitute the entire agreement between you and Hikari Blue regarding the Site, and supersede any prior agreements, understandings, or communications.
17. Force majeure
Hikari Blue shall not be liable for any failure or delay in performance arising from causes beyond its reasonable control, including without limitation acts of God, natural disasters, pandemics, war, terrorism, civil unrest, governmental action, labor disputes, internet failures, or third-party service interruptions.
18. Notices
Any notice to Hikari Blue under these Terms shall be sent by email to direct email with confirmation copy by certified mail to UNITED4 LLC, 14205 N Mopac Expy, Suite 570, Austin, TX 78728, USA. Notices to you may be sent to the email address you provide or by posting on the Site.
19. Accessibility (ADA & WCAG)
Hikari Blue is committed to making the Site accessible to all users, including those with disabilities, in accordance with the Americans with Disabilities Act (ADA) and the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA, and is targeting Level AAA for long-form editorial content.
